This Consumer Health Data Privacy Policy explains how Marius Pharmaceuticals LLC (“Marius Pharmaceuticals,” “we,” “us,” or “our”) collects, uses, and shares “consumer health data” as defined by the Washington My Health My Data Act and Nevada Senate Bill 370, and the rights available to you with respect to that data. It applies to Washington and Nevada consumers and to consumer health data collected in those states through our websites, mobile applications, and digital services (“websites”), including kyzatrex.com. Our general privacy practices are described in our Privacy Statement.
Consumer Health Data We Collect
Depending on how you interact with our websites, we may collect the following categories of consumer health data:
- Information about your health conditions, symptoms, or diagnoses that you provide to us, such as responses to the ADAM screening questionnaire (Low Testosterone Quiz) or information submitted through the telehealth intake flow
- Information about your efforts to seek health care services, such as clicking “Find a Provider,” submitting a ZIP code to search for providers, or initiating the “Get Started” / “Get KYZATREX” pathway
- Questions you submit to interactive tools on our websites, such as the “Ask AI about Kyzatrex” feature, to the extent they reveal health information
- Data that could identify your interest in or use of a prescription medication, including online identifiers combined with your activity on health-related pages of our websites
- Location information that could reasonably indicate an attempt to acquire health services, such as a ZIP code submitted to our provider search
Sources of Consumer Health Data
We collect consumer health data directly from you, through the forms, questionnaires, and interactive tools you use on our websites, and automatically from your device when you use our websites, through cookies and similar technologies described in the Cookies and Other Tracking Technologies section of our Privacy Statement.
Why We Collect and Use Consumer Health Data
We collect and use consumer health data to provide the products, services, and information you request, including helping you assess symptoms, find a provider, and access Kyzatrex; to respond to your inquiries; to comply with legal obligations; and, only with your separate consent, for marketing and advertising purposes.
How We Share Consumer Health Data
We share consumer health data with the following categories of recipients:
- Our affiliates
- Service providers and processors that operate our websites and support the services you request (including website hosting, analytics, and communications vendors bound by contractual limitations on their processing of consumer health data)
- Health care professionals and telehealth partners, at your direction
- Government or law enforcement authorities where required by law
We do not share consumer health data with third parties for their own purposes without your consent. Upon request, we will provide you with a list of the specific third parties and affiliates with whom we have shared your consumer health data, along with their contact information.
We do not sell consumer health data. We will not sell consumer health data without first obtaining a valid authorization that complies with applicable law, which you may revoke at any time.
Your Rights
Subject to certain exceptions, you have the following rights with respect to your consumer health data:
- Right to know: confirm whether we collect, share, or sell your consumer health data, and access that data, including a list of the third parties and affiliates with whom we have shared it and their contact information
- Right to withdraw consent: withdraw your consent to our collection or sharing of your consumer health data
- Right to delete: request deletion of your consumer health data
- Right to appeal: appeal our refusal to take action on a request
How to Exercise Your Rights

We will verify your identity before acting on your request and will respond within the time required by applicable law. You will not be discriminated against for exercising your rights.
If we deny your request, you may appeal our decision by replying to our response with the subject line “Appeal.” We will respond to your appeal in writing with an explanation of our decision. If your appeal is denied, you may contact the Washington Attorney General at atg.wa.gov or the Nevada Attorney General at ag.nv.gov.
