You do not have to share your PI with us, but if you choose not to share your PI, we may not be able to provide you with certain information, products or services.

In the ordinary course of business, Marius Pharmaceuticals sometimes collects Social Security numbers to fulfill legal or regulatory obligations or for other administrative purposes. We respect the confidentiality of Social Security numbers and we avoid the unnecessary collection of them, limit access to them, and disclose them only (i) according to Marius Pharmaceuticals’ internal privacy policy and procedures, (ii) with those third parties who are legally or contractually obligated to protect them, and (iii) as required or permitted by law.

We may use PI to create de-identified and/or aggregated data that is no longer associated with an identifiable individual. We may use and share this de-identified or aggregated information for our lawful business purposes.

When you visit our websites, we and third parties acting on our behalf use cookies, web beacons, pixels, scripts, and similar technologies (collectively, “cookies”) to operate the websites, analyze how they are used, and support our advertising.

• Microsoft Advertising (Bing) (advertising). Supports ad delivery and conversion tracking on the Microsoft network. Receives your IP address, device and browser information, and cookie identifiers.
• LinkedIn Insight Tag (advertising). Supports ad measurement and interest-based (targeted) advertising on LinkedIn. Receives your IP address, device and browser information, pages viewed, and event data.
• iPredictive (advertising). Supports programmatic advertising and audience targeting. Receives your IP address, device and browser information, cookie identifiers, and pages viewed.
• Alo (alocdn) (advertising). Supports visitor identification and ad retargeting. Receives your IP address, device and browser information, cookie identifiers, and pages requested.
• Microsoft Clarity (analytics / session replay). Creates session recordings and heatmaps used to understand how visitors use our websites. Receives your IP address, device and browser information, cookie identifiers, and recordings of clicks, scrolling, and page interactions.
• HubSpot (analytics / marketing automation). Supports visitor analytics, marketing automation, and management of communications you request. Receives your IP address, device and browser information, cookie identifiers, pages viewed, and form interactions.
• Brevo (marketing automation). Supports email and marketing automation for communications you request. Receives your IP address, device and browser information, and pages requested.
• Google reCAPTCHA (security). Protects our forms against bots and abuse. Receives your IP address, device and browser information, and abuse-prevention signals.
• Google Maps (functionality). Displays interactive maps, including provider location features. Receives your IP address, device and browser information, and map interaction data.
• Google Fonts (functionality). Delivers the fonts displayed on our websites. Receives your IP address and device and browser information.
• Vimeo and YouTube (functionality; Prescriber Site). Host and play embedded video content. Receive your IP address, device and browser information, and video viewing data.
• Bending Spoons / Orion (analytics; Prescriber Site). Telemetry associated with embedded content. Receives your IP address, device and browser information, and request data.
• Google (Content Security Policy reporting) (security; Prescriber Site). Receives Content Security Policy violation reports to help enforce website security. Receives your IP address, device and browser information, and request data.

• __hstc, hubspotutk, __hssc, and __hssrc (HubSpot; analytics and marketing). Track visitors and sessions to support analytics and marketing automation. Duration: 30 minutes to 6 months.
• cu (iPredictive; advertising). Unique identifier used to build audience profiles for targeted ads. Duration: 12 months.
• uuid, _ep, and alo_uid (Alo / alocdn; advertising). Unique identifiers used to recognize and retarget visitors. Duration: 1 day to 12 months.
• sib_cuid (Brevo; marketing). Identifies the visitor to support marketing automation. Duration: 6 months.
• entry_url, current_url, entry_http_referrer, current_http_referrer, and user_ip (Kyzatrex.com first-party; analytics and attribution). Record the pages you enter and view, the referring website, and your IP address. Duration: 90 days.
• __cf_bm (Cloudflare, via HubSpot; strictly necessary). Bot protection and security. Duration: 30 minutes.
• YSC, VISITOR_INFO1_LIVE, __Secure-YNID, VISITOR_PRIVACY_METADATA, and __Secure-ROLLOUT_TOKEN (YouTube; functionality; Prescriber Site), and vuid (Vimeo; functionality; Prescriber Site). Support embedded video playback and measure video views. Duration: session to 12 months.

Your Consent to Cookies

Where required by law, we do not set analytics or advertising cookies, and the third parties listed above do not collect data from your visit, unless you first consent through the cookie banner presented when you visit our websites. You may change or withdraw your consent at any time by selecting “Cookie Preferences” in the footer of our websites. Withdrawing consent does not affect the lawfulness of processing before withdrawal.

Additional Ways to Manage Cookies and Targeted Advertising

• Browser settings: with most internet browsers, you can erase cookies from your device, block all cookies, or receive a warning before a cookie is stored. If you reject cookies, functionality of the site may be limited.
• Industry opt-outs: you may opt out of targeted advertising by participating companies through the Network Advertising Initiative (optout.networkadvertising.org) and the Digital Advertising Alliance (optout.aboutads.info). Opt-Out Preference Signals (Global Privacy Control)

Our websites recognize opt-out preference signals, such as the Global Privacy Control (GPC). If your browser or browser extension transmits a GPC signal, we will treat it as a valid request to opt out of the “sale” of your PI and “sharing”/processing of your PI for targeted advertising for that browser.

Social Media Plug-ins

Our websites may use social media plug-ins to enable you to share information with others easily. When you visit our websites, the operator of the social media plug-in can place a cookie on your computer that lets that operator recognize individuals who have previously visited our websites. Social media plug-ins may allow social media websites to receive directly identifiable information about you that shows you have visited our website, whether or not you specifically interact with the plug-in. This website is not intended for or designed for individuals under the age of 18. We do not knowingly collect PI from any person under the age of 18, unless a parent or guardian provides consent.

We may share your PI with third parties in connection with work that they do for or with Marius Pharmaceuticals, for purposes consistent with those listed above. These third parties must agree to protect the PI and to use it only as directed by Marius Pharmaceuticals.
Information you submit to us via text messaging will not be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties.

As described in Section 2, we also disclose online identifiers and internet activity information to advertising and analytics partners. Where this activity constitutes a “sale” of PI or “sharing” of PI for targeted advertising under applicable state privacy laws, you have the right to opt out as described in Sections 8 and 9, and where consent is required (including for consumer health data as described in Section 12), we obtain it before the disclosure occurs.

We may also be required to disclose your information in response to lawful information requests for PI by law enforcement authorities, the courts or regulatory authorities, including complying with national security or law enforcement requests.

In the event that Marius Pharmaceuticals may decide to reorganize or divest part or all of its business, including its information databases, through a sale, divestiture, merger, acquisition or other means of transfer, then PI may be shared with, sold, transferred, rented, licensed or otherwise provided or made available by Marius Pharmaceuticals to third parties in connection with the contemplated transaction. In such circumstances, Marius Pharmaceuticals will seek written assurances that the PI will be protected appropriately.

This website is owned and operated by Marius Pharmaceuticals in the United States. However, any information collected on this website may be transferred to other Marius Pharmaceuticals affiliates and third parties worldwide. Some of Marius Pharmaceuticals’ affiliates and third parties may be located in countries that do not require the same level of data protection as the country you reside in. When transferring PI across country borders, Marius Pharmaceuticals and its affiliates utilize appropriate transfer mechanisms as applicable (which may include consent, Standard Contractual Clauses, existing adequacy decisions, etc.). All of Marius Pharmaceuticals’ affiliates are required to treat PI in a manner consistent with this notice and Marius Pharmaceuticals’ internal global privacy policies.

PI will be saved for a period of time needed to fulfill legitimate and lawful business purposes in accordance with our record retention policies and applicable laws and regulations. Retention periods for cookies are listed in the cookie table in Section 2.

We provide reasonable physical, technical and procedural safeguards to protect PI we work with and maintain. We limit access to PI to authorized employees and third parties who need access to carry out their assigned roles and responsibilities on behalf of Marius Pharmaceuticals. Although we strive to protect the PI we work with and maintain, no security system can prevent all potential security breaches.

Depending on your state of residence and subject to certain exceptions, you may have the right to:

• Know/access: request confirmation of whether we process your PI and receive a copy of the PI we have about you
• Correct: request that we correct inaccurate PI
• Delete: request that we delete PI we have collected from you
• Data portability: receive a copy of your PI in a portable and, to the extent technically feasible, readily usable format
• Opt out of targeted advertising: direct us not to process your PI for interest-based (targeted) advertising
• Opt out of sale: direct us not to “sell” your PI as defined under applicable law
• Opt out of profiling: direct us not to profile you in furtherance of decisions that produce legal or similarly significant effects
• Limit or withdraw consent for sensitive data: where we process sensitive PI (such as health data or precise geolocation) based on your consent, withdraw that consent at any time
• Restrict processing: ask us to restrict or stop processing your PI in certain circumstances, such as where we process sensitive PI or engage in certain automated decision-making
• Appeal: appeal a decision we make on your request; if we deny your appeal, you may contact your state Attorney General

To opt out of targeted advertising, you may also use the “Cookie Preferences” link on our websites or transmit an opt-out preference signal such as Global Privacy Control, as described in Section 2.

We will verify your identity before acting on your request, and we may ask for additional information to do so. There may be exceptions that apply to your request. We will respond within the time required by applicable law (generally 45 days, with a possible 45-day extension where permitted). You will not be discriminated against for exercising any of your rights. Where permitted by law, we may charge a reasonable fee for repeated or excessive requests.

Marketing communications. You can opt out of receiving marketing communications from us at any time by following the unsubscribe instructions in each message, or by contacting us as set forth in the “How to Contact Us” section below. Even if you opt out of marketing messages, we may still contact you about your requests, orders, or the services you have asked us to provide.

The California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”), entitles California residents to the rights described in Section 8, as well as the additional disclosures in this section.

In the preceding 12 months, we have collected the categories of PI listed in Section 1, from the sources listed in Section 1, for the purposes listed in Section 1, and we have disclosed each of those categories to the recipients described in Sections 1, 2, and 4.

We do not sell PI in exchange for money. However, our disclosure of online identifiers and internet or other electronic network activity information to the advertising partners listed in Section 2 for targeted advertising may constitute a “sale” of PI or “sharing” of PI for cross-context behavioral advertising under the CCPA. California residents may opt out of such sale or sharing via the “Cookie Preferences” link, or by transmitting a Global Privacy Control signal. We do not knowingly sell or share the PI of consumers under 16 years of age.

Sensitive PI: where we collect sensitive PI as defined by the CCPA (such as health information), we collect it with your consent or as otherwise permitted by law, and we do not use or disclose it for purposes other than those permitted under the CCPA without providing you a right to limit.

California Civil Code Section 1798.83 (“Shine the Light”) entitles California residents who have an established business relationship with Marius Pharmaceuticals to request information regarding our disclosure of certain PI to third parties for their direct marketing purposes. NOTICE: We may sell your sensitive personal data.

As described in Section 2, our websites recognize opt-out preference signals such as the Global Privacy Control. Other “Do Not Track” browser signals for which no legal standard has been adopted may not be recognized.
